The Status of Health Insurance Exchanges | The Health Care Blog


With less than two years before state-based health insurance exchanges are to be operational, most state legislators and health policy experts still cannot come to an agreement on how to set up, operate, monitor or fund state exchanges. However, despite persistent confusion and concerns surrounding health insurance exchanges, the White House recently released a?report on the progress of state-level health insurance exchanges. This publication took a favorable and possibly misleading view of the headway being made by states that are creating their online insurance marketplaces.

The Administration claimed that there are currently 28 states making great progress in establishing an exchange. Even if that were true, this indicates that 22 states ?-or about 40 percent- are refusing to comply with the Patient Protection and Affordable Care Act (PPACA).

Although the report does not lie, it also doesn?t exactly accurately portray where most states stand either? The Administration chose to furtively count states that fall into a grey area as making progress toward setting up an exchange. Many states have, in actuality, refrained from any legislative activity or the state legislature has merely set up a committee to ?study options?. What this really indicates is that many states are purposefully not complying with the PPACA mandate to create an exchange, but also managing not to violate it so that they are allowed to keep federal funding, at least until the January 2014 deadline.

The figure illustrates exchange status more accurately by categorizing, into six categories, where states stand in terms of state-based exchange implementation. These classifications range from states that have already established an exchange to states who have taken legislative action not to create an exchange.

As the White House rightly exhibited, there are a few states that have made significant progress in setting up an exchange and benefited greatly from the extra federal dollars. Rhode Island recently received an additional $60 million from the federal government for their collaboration with Massachusetts and Vermont to improve system integration associated with health insurance exchanges. California, Colorado and Washington have also seen legislation signed into law following the passage of PPACA to implement a state health insurance exchange.

In contrast, based on a February 2012 analysis of all states, Figure 1 shows that five states have no legislative activity whatsoever related to a health care exchange; and several states such as Wisconsin, Louisiana and Florida not only rejected setting up an exchange, but returned the grant money bestowed to them from the federal government to establish an exchange. More common scenarios, and where Figure 1 differs from the White House, are that many states are merely ?investigating options? or allowing an exchange bill to bounce around legislative committees but never go to a vote. These alternatives allow states to keep their federal funding, but take no action to set up an exchange.

For example, the state of North Carolina had a Republican majority who drafted an exchange bill. That bill, however, was moved from one committee to another over than span of months for ?reading.? For the past year, that same bill hasn?t seen the light of day and the Republican majority has no intention of ever letting it. This way, the state is allowed to spend federal exchange dollars, but not actually carry out the Administration?s plans. New Hampshire also had an exchange bill written, but after passing the Senate, that bill failed to pass the House of Representatives. In doing so, New Hampshire was allowed to keep exchange funding, but use the stalemate as a way of not having to revisit the idea of exchange implementation until a future session. South Carolina on the other hand used the original Exchange Planning Grant from the federal government to create an exploratory committee on exchanges, but decided after its creation that no legislation should be written.

As the economic crisis continues, unemployment remains high and the Supreme Court prepares to hear oral arguments for various provisions of PPACA in March, the number of states moving forward with enacting an exchange should become stagnant. This could further undermine the ?progress? being made by states that fall into the grey area. Regardless, whether states are stalling efforts to create state-level exchanges, ?studying? alternative options and costs, or flat out rejecting the idea, it?s safe to say that the optimism demonstrated in the White House report is a bit rosier than the real state of state-level health insurance exchanges.

US futures trim early gains on durable goods drop

(AP) ? U.S. stock futures have trimmed their early gains after a report showed weaker-than-expected orders for long-lasting products.

Dow Jones industrial average futures are up 16 points to 12.85, while Standard & Poor's 500 futures are flat at 1,367. Nasdaq composite index futures added 4 points to 2,612.

The gains come as Europe is having a mostly positive day after a dip in oil prices. Germany's DAX is up 0.43 percent to 6,879. France's CAC 40 is up 0.43 percent to 3,456. Britain's FTSE 100 edged down 0.33 percent to 5,915.

Oil prices are down to $108.50 a barrel on weaker Asian demand.

The Commerce Department says January orders for durable goods fell by a steeper-than-expected 4 percent.

U.S. stocks to watch include Hovnanian Enterprises. The homebuilder says first-quarter contracts climbed.

Gingrich once ran as GOP moderate early in career

CARROLLTON, Ga. ? The young political candidate sought support from labor unions. He castigated corporations for "raping" the environment. He demanded that big oil companies open their financial books for inspection.

This was not the platform of a liberal Democrat, but rather the agenda of Republican Newt Gingrich when he ran for Congress in west Georgia in the mid-to-late 1970s.

Now as a presidential candidate, Gingrich calls himself a true conservative and derides former Massachusetts Gov. Mitt Romney, a main rival, as a "Massachusetts moderate." Long before Gingrich reached the national spotlight, he embraced many moderate and even liberal policy positions that would be anathema in this year's White House race.

"The Republican Party has to be the conservative party if it is to mobilize the 61 percent of the country which calls itself more conservative than liberal," Gingrich wrote in a paper kept by his former press secretary, Lee Howell, that examined the prospects for the 1976 election. "However this conservatism has to be moderate if the party is not to be isolated from the bulk of the population which rejects either extreme."

Howell eventually split with Gingrich and has been critical of him over the years. Local newspaper stories about Gingrich's early races include remarks from the candidate that match or are very similar to language in the speeches, news releases and memos from Howell.

Gingrich's early runs for Congress show the beginning of threads that would develop throughout his career. Despite living in Georgia, then a Deep South bastion for Democrats, Gingrich believed that Republicans could assemble a majority in Congress. He also was willing to get mean on the campaign trail, a trait that continued throughout his career.

Gingrich ran as a moderate for several reasons. First, he was challenging a deeply conservative pro-segregation Dixie Democrat. The Republican Party itself was different, too.

"I think it's a different world," said Bill Loughrey, a Gingrich supporter who met the candidate while working in a research office for House Republicans in the late 1970s. He answered questions about Gingrich's old policy positions on behalf of the campaign. "There were a lot of liberal Republican and conservative Democrats back then. You had a very large segment of the Republican Party that was moderate to liberal."

Ever since the end of Reconstruction after the Civil War, Georgia had been solidly Democratic. While national Democrats such as President Lyndon Johnson backed civil rights legislation in Congress, Georgia Democrats supported racial segregation. That included U.S. Rep. John Flynt Jr., a signer of the 1956 "Southern Manifesto" condemning the U.S. Supreme Court ruling that led to racial integration in schools.

"Jack Flynt was the most conservative congressman in Georgia, and you didn't run against Flynt on the right," said Howell, a student at West Georgia College who handled press relations for Gingrich's campaign. "You had to be more moderate than Flynt. You couldn't get to his right."

Gingrich's first two campaigns against Flynt muddled party lines.

Flynt, the Democrat, publicly accused Gingrich of being a supporter of the 1972 Democratic presidential candidate Georgia McGovern, a liberal anti-war Northerner who lost badly in Georgia. Gingrich quickly gave interviews denying that accusation, saying he worked instead for Republican Richard Nixon's campaign.

Gingrich ran the campus's environmental studies program and during his first campaign condemned a plan to build a dam on the Flint River. He had harsh words for corporate polluters while simultaneously showing contempt for environmental regulators.

"Greedy economic giants are raping the environment, polluting the water we drink and the air we breathe ? yet all too often the reformers offer solutions that will lead to unemployment and economic chaos," Gingrich said, according to a copy of his 1974 campaign kickoff speech kept by Howell.

Gingrich never uses such harsh language now to describe business interests on the campaign trail. His criticism of the regulators has remained strident. He has more recently called the Environmental Protection Agency a "job killer" that must be replaced.

Local newspaper coverage from the time shows that Gingrich was endorsed in 1976 by the state affiliate of the National Education Association and, his former supporters say, the Communication Workers of America. The relationship with teachers did not last long. By 1985, Gingrich was denouncing the NEA as part of a "left-wing alliance" in a speech he gave to school board officials, according to papers from Gingrich's archive at the University of West Georgia.

At times, Gingrich made statements that might be cheered today by Occupy Wall Street protesters. For example, he denounced the corporate profits accrued by oil companies and said the companies needed to open their records for inspection. He was running in the aftermath of an oil embargo imposed by Arab states to punish the United States for giving military support to Israel. The embargo caused gas prices to skyrocket and led to shortages at the pumps.

"Today, the American oil industry is receiving windfall profits while the American people are paying through their noses for home heating oil and gasoline," Gingrich said, according to a copy of an Oct. 26, 1974, speech that he gave in Carrollton.

He was also skeptical of proposals to deregulate natural gas prices and the airline industry, positions contrary to his free-market stances today.

Gingrich's pronouncements on oil companies caused a mini-crisis with Arizona Sen. Barry Goldwater, a champion of the GOP's conservative wing who endorsed Gingrich and appeared in Georgia on the candidate's behalf in 1976. Howell said Goldwater threatened to pull his support after reading about Gingrich's tough talk on oil companies.

"He was so livid he was ready to come down to the Georgia and withdraw his endorsement and condemn Gingrich," Howell said. "It took some saner heads at the Republican National Committee and some other the guys in Washington to calm him down, let him know that was something Newt had to do in order to get some attention."

Gingrich's early races in Georgia show his comfort with rough-and-tumble campaign tactics. Former campaign treasurer L.H. "Kip" Carter said that Gingrich took out newspaper ads highlighting Gingrich's involvement in his Baptist church, while noting that his Democratic opponent, Virginia Shapard, was a "communicant" at an Episcopal church. Carter said the goal was to make Shapard seem like a Roman Catholic to rural and overwhelmingly Baptist voters.

Carter said that ad also told voters that Gingrich would take his family to Washington; Shapard would leave her children with a nanny.

"I look back on this and it's embarrassing," said Carter, now a fierce Gingrich critic. "In fact, I've apologized."

Gingrich long told Republicans that winning elections meant getting tough. Howell's files contained an unsigned memo on Gingrich campaign stationary intended for the upcoming 1976 election. It contains a fictionalized account of how Republicans win control of the U.S. House of Representatives and foreshadows several of the tactics that Gingrich used in 1994 when he led the Republicans to their first House majority in 40 years.

The memo urged GOP congressional candidates to run on a national platform. In 1994, Gingrich and other strategists did just that. They created "The Contract with America," a common set of promises endorsed by GOP candidates.

Gingrich's campaign also told Republicans to go negative on a national scale. It wanted to design a common TV ad telling viewers that their local Democratic incumbent was allied with other Democrats then caught up in political scandal.

"Democrats are willing to play ruthlessly hard ball," the memo said. "Note their grim, unfair exploitation of Watergate. Republicans usually hit too soft, too vaguely, and don't connect the issue, the voters' interest, and Democratic wrongdoing."

Chipotle Still Sizzling (CMG, SBUX, PNRA, MCD) | Avid Investor Group

Chipotle Mexican Grill (NYSE:CMG) reported its financial results for the fourth quarter and full year ended Dec. 31, 2011. During the quarter, revenues increased by?23.7% to $597 million while net income grew by 24% to $58 million. Diluted EPS for the quarter was $1.81. Analysts were expecting EPS of $1.83 in the quarter on revenues of $591 million.

No Surprises
The fact that Chipotle beat estimates on the revenue front and missed on the EPS estimate is really no surprise. The strong sales figures had to absorb higher food costs during the quarter, which came in at 32.2%, up 1.2 percentage points as a result of higher commodity costs. For the full year, food costs were up nearly 2 percentage points.

Yet thanks to strong customer traffic and stronger sales volume, overall restaurant operating margins were 26%, down only 70 basis points as higher food costs were somewhat mitigated by stronger restaurant sales. Chipotle ended the year with 1,230 restaurants, opening 150 new location in 2011, including one ShopHouse,?the company?s newest concept. (For related reading, see How To Analyze Restaurant Stocks.)

Still Sizzling
Looking ahead in 2012, Chipotle plans to open between 155-165 new restaurants. The company is forecasting mid-single-digit comparable restaurant sales growth. That compares with 11% comp sales in 2012. This forecast is likely a very conservative figure.

Unfortunately, while the business of Chipotle will likely do very well in 2012, an investment in Chipotle may not be as hot. After hours, shares declined 2% on the earnings news. Still, Chipotle remains one of the most expensive restaurant stocks trading at over 55 times 2011 earnings. While Chipotle?s amazing growth is deserving of a strong valuation, shares of Bread Company (Nasdaq:PNRA) trades for 33 times 2011 earnings.

Even Starbucks (Nasdaq:SBUX), which is enjoying a?great comeback thanks to the return of founder Schultz trades at?half the valuation of Chipotle.?It?s even hard to ignore McDonald?s (NYSE:MCD), Chipotle?s former parent, trading at about 19 times earnings and yielding 2.8%. McDonald?s is not growing like Chipotle, but Mickey D?s is thriving in this environment.

Chipotle is an excellent business thriving in a very tough industry. It?s doubtful that any restaurant or hospitality business can match Chipotle?s growth at the moment, and Wall Street has elevated the share price to new highs as a result. While even a slowdown in Chipotle?s growth would be viewed as excellent growth in the restaurant industry, Chipotle?s valuation may cool off if the company is entering the next phase of its growth cycle.

What to Expect When You're Expecting Set Visit ? A Mom's ...

A few months ago I had the amazing experience of visiting Atlanta and watch a scene being filmed from the upcoming movie What to Expect When You?re Expecting.? It is kinda ironic that I was in fact pregnant, but not far enough to tell anyone.? Here I was surrounded by pregnant people (and people wearing fake tummies) thinking to myself that in a few short months I will have a belly just like them!

A select group of bloggers and I visited the Georgia World Conference Center in early September to watch Elizabeth Banks film one of her scenes from the movie.? Elizabeth Banks plays Wendy Cooper, a boutique owner who had dreamt about being a mother for a long time.? Her pregnancy isn?t as blissful as she had imagined it to be.? It is also further complicated by the fact that her younger mother in law is also expecting.? We were able to see her film a scene in which Wendy was addressing a crowd at the ABC Kids Expo and instead of promoting her boutique, ?The Breast Choice?? she let out all her frustrations about being pregnant.? Elizabeth Banks was hilarious as she listed all of the horrible things about pregnancy (all of which have seemed to happen to her character).? We watched her do over 20 takes before they took a break.? During the break she took time to meet with us bloggers to talk about her role in this movie as well as how motherhood has been treating her (her son Felix was born last March). Stay tuned next week for the interview with Elizabeth!

The story behind What to Expect When You?re Expecting isn?t really an informational film like the book is, it follows the pregnancies of 5 couples as they are expecting children.? The cast includes amazing actors such as Jennifer Lopez, Cameron Diaz, and Anna Kendrick.

The story lines are somewhat separate, yet they interact with each other (think kinda like Love Actually).? I love Wendy because I can totally relate to not liking being pregnant.? With the variety of actors, there is a character in which most women will be able to relate too, including women who are expecting through adoption.

What to Expect When You?re Expecting comes to theatres nationwide on May 11, 2012 just in time for Mother?s Day.
