VW gives workers a rest from Blackberry messages (Reuters)

FRANKFURT (Reuters) ? Volkswagen has agreed to grant workers in Germany a rest from e-mails relentlessly filling the inboxes of their Blackberry devices out of hours.

Europe's biggest carmaker and the body that represents its workers have agreed to have the e-mail function deactivated at night, a spokesman for the company said, confirming an earlier report in a German newspaper.

Workers will only receive e-mails from half an hour before the start of flex-time working hours until half an hour after they end, but will still be able to receive and make phone calls.

Daily Wolfsburger Allgemeine Zeitung this week cited works council member Heinz-Joachim Thust as saying that 1,154 pay-scale employees at Volkswagen's six plants in Germany have a smartphone device furnished by the company.

The works council sought to counter any expectation that employees should be reachable all the times, thanks to their indispensable "CrackBerry" gadgets, which could heighten the risk of burnout, a psychological syndrome that some studies have said causes almost 10 million sick days a year in Germany.

So far, the response to the decision to deactivate e-mails at night has been very positive, VW's Thust told Wolfsburger Allgemeine Zeitung.

The move comes two months after millions of customers of the Blackberry -- made by Research in Motion -- were frustrated by a three-day global service disruption, showing how much many rely on continuous, reliable e-mail and instant messenger service.

Volkswagen, which has about 400,000 employees worldwide, aims to overtake Japan's Toyota as the world's biggest carmaker by 2018 by selling 10 million vehicles per year.

The group logged 7.51 million deliveries for the first 11 months of this year, after a 15 percent gain in November.

LAD creditors oppose Fox effort to halt sale order (AP)

DOVER, Del. ? Creditors of the Los Angeles Dodgers are joining the team in urging a federal district judge not to halt implementation of a bankruptcy court order authorizing the Dodgers to begin a process for selling television rights to future games.

In a filing Wednesday, the committee said there's no guarantee that a sale of the team without the TV rights will result in Dodgers creditors being paid in full.

The committee noted that the Dodgers face several unreconciled claims, including a lawsuit filed on behalf of a San Francisco Giants fan who is represented on the creditors committee and was critically injured in an assault outside Dodger Stadium on opening day.

Fox is challenging the proposed media rights sale, saying it violates the company's rights under an existing contract with the Dodgers.

Utah Woman Andrea Chavez Accused Of Assaulting Ice Cream Truck Driver's Face Because Prices Were Too High

TAYLORSVILLE, Utah -- A Utah woman faces misdemeanor charges after police say she sprayed an ice cream truck driver in the face with cleaning solution because she was upset about the driver's prices.

Authorities in the Salt Lake City suburb of Taylorsville say 65-year-old Andrea Chavez told them she sprayed the woman because "she charges too much for ice cream."

The incident happened Aug. 7 at an apartment complex. Charges were filed Monday, though the reason for the delay was unknown. A message left for Salt Lake County prosecutors was not immediately returned Tuesday.

Police say the driver was briefly hospitalized after being hit in the eyes with Mean Green cleaner, a product described on its website as a blend of nontoxic, biodegradable detergents.

Court papers say Chavez fought off Taylorsville police officer Mike Ikemiyashiro when he tried to take her into custody, threatening to "sock him in the face" and kick him in the groin.

Salt Lake County sheriff's office records show Chavez was booked into jail after the incident and held for three days. She was released when no charges were filed. By law, authorities can hold someone in jail for only 72 hours without filing charges.

On Monday prosecutors charged Chavez with four misdemeanors: assault against a police officer, assault, interfering with an officer and committing a violent offense in front of a child. If convicted, she faces a combined punishment of two and half years in the county jail.

An arraignment is set for Jan. 4 in Salt Lake City's 3rd District Court.

It wasn't immediately clear Tuesday if Chavez had an attorney. A telephone message left at a listing under her name wasn't returned.

Rsearchers demonstrate new DNA detection technique

ScienceDaily (Dec. 16, 2011) ? A team of researchers from the University of Notre Dame have demonstrated a novel DNA detection method that could prove suitable for many real-world applications.

Physicists Carol Tanner and Steven Ruggiero led the team in the application of a new technique called laser transmission spectroscopy (LTS). LTS is capable of rapidly determining the size, shape and number of nanoparticles in suspension.

In a new paper appearing in the international, peer-reviewed, open-access, online publication PLoS ONE, the team describes how they applied LTS as a novel method for detecting species-specific DNA where the presence of one invasive species was differentiated from a closely related invasive sister species.

The research was carried out in support of and cooperation with Notre Dame's Environmental Change Initiative (ECI). Scientists from ECI are using environmental DNA (eDNA) as part of their surveillance of Asian carp in the Great Lakes region.

The results of the research demonstrate the basic premise of DNA detection by LTS in the laboratory.

The Notre Dame research team points out that the LTS technique has many benefits over established DNA detection techniques. The technique is highly sensitive and takes only a few seconds to genetically score a sample for species presence or absence. The researchers also feel that LTS technology will prove much more rapid, practical and cost effective than current detection methodologies and could ultimately reach the sensitivity required to eliminate the need for polymerase chain reaction (PCR) amplification.

Although the current paper describes the use of LTS in invasive species detection, the Notre Dame researchers believe that the technique could serve as an important tool in detecting human pathogens and understanding and indicating the presence of genetic diseases such as cancer.

Senate OKs short-term extension of payroll tax cut

Senators racing for the exits after a year of bitter battles passed legislation Saturday that would extend a Social Security payroll tax cut and jobless benefits for just two months, setting the stage for the next fight until February.

While a partial victory for President Barack Obama's year-end jobs agenda, the measure awaiting House approval next week contains a provision demanded by Republicans to pressure the White House into approving construction of a Canada-to-Texas oil pipeline that promises thousands of jobs.

While pleased by the Senate vote, Obama said "it would be inexcusable for Congress not to further extend this middle class tax cut for the rest of the year. It should be a formality, and hopefully it's done with as little drama as possible when they get back in January."

He added, "This really isn't hard. There are plenty of ways to pay for these proposals."

Democratic and GOP leaders option for the short-term extension after failing to agree on big enough spending cuts to pay for a full-year renewal of the payroll tax cut. The 2 percentage point tax cut affects 160 million taxpayers. The weekly jobless payments average about $300 for millions of people who have been out of work for six months or more.

The measure was approved by an 89-10 vote during a Saturday session.

Votes were scheduled later Saturday on a $1 trillion-plus catchall spending measure setting the day-to-day budgets of 10 Cabinet agencies. The House cleared the spending bill Friday.

In a statement, White House communications director Dan Pfeiffer indicated Obama would sign the two-month extension measure, saying it had met his test of "preventing a tax increase on 160 million hardworking Americans" and avoiding damage to the economy recovery.

The statement made no mention of the pipeline.

The legislation, would require the president to grant a permit, but allows Obama to opt not to do so if he determines that the pipeline is "not in the national interest." One senior administration official said the president would almost certainly refuse to grant a permit. The official was not authorized to speak publicly.

The developments came a few hours after the White House publicly backed away from Obama's threat to veto any bill that linked the payroll tax cut extension with a Republican demand for a speedy decision on the 1,700-mile Keystone XL oil pipeline proposed from Canada to Texas Gulf Coast refineries.

Obama said on Dec. 7 that "any effort to try to tie Keystone to the payroll tax cut I will reject. So everybody should be on notice."

Obama recently announced he was postponing a decision until after the 2012 elections on the much-studied proposal. Environmentalists oppose the project, but several unions support it, and the legislation puts the president in the uncomfortable position of having to choose between customary political allies.

Republican senators put the price of the two-month package at between $30 billion and $40 billion said the cost would be covered by raising fees on new mortgages backed by Fannie Mae and Freddie Mac.

The fees, drawn from a Treasury Department housing finance market reform plan, would add several thousand dollars to the 30-year cost of home loans guaranteed by mortgage giants Fannie Mae Freddie and Freddie Mac and the Federal Housing Administration.

A worker making a $100,000 salary would reap a tax cut of about $330 through the short-term payroll tax extension.

A version of the fee that circulated overnight would effectively raise the interest rate on a mortgage by one-tenth of one percentage point, but the still-undetermined final version ? awaiting analysis from the Congressional Budget Office ? was expected to be lower.

The measure also provides a 60-day reprieve from a scheduled 27 percent cut in the fees paid to doctors who treat Medicare patients.

Officials said that in private talks, the two sides had hoped to reach agreement on the full one-year extension of the payroll tax cut and unemployment benefits that Obama had made the centerpiece of the jobs program he submitted to Congress last fall.

Those efforts failed when the two sides could not agree on enough offsetting cuts to blunt the measure's impact on the debt.

The failure tees up the issue again for early next year, but it won't get any easier to agree on spending cuts. The

"We'll be back discussing the same issues in a couple of months, but from our point of view, we think the keystone pipeline is a very important job-creating measure in the private sector that doesn't cost the government a penny," said Sen. Mitch McConnell of Kentucky, the Republican leader.

Another vote, another headache
Neither House Speaker John Boehner, R-Ohio, nor his aides participated in the negotiations, although McConnell said he was optimistic about the measure's chances for final approval. The payroll tax cut is unpopular in GOP ranks and another vote in two month could present a headache for GOP leaders.

The State Department, in an analysis released this summer, said the pipeline project would create up to 6,000 jobs during construction, while developer TransCanada put the total at 20,000 in direct employment.

The 1,700-mile pipeline would carry oil from western Canada to Texas Gulf Coast refineries, passing through Montana, South Dakota, Nebraska, Kansas and Oklahoma.

The spending bill would lock in cuts that conservative Republicans won from the White House and Democrats earlier in the year.

Republicans also won their fight to block new federal regulations for light bulb energy efficiency, coal dust in mines and clean water permits for construction of timber roads.

The White House turned back GOP attempts to block limits on greenhouse gases, mountaintop removal mining and hazardous emissions from utility plants, industrial boilers and cement kilns.

Ousted shah's son wants Iran leader tried in court (AP)

PARIS ? The exiled son of the toppled shah of Iran said Thursday he plans to ask the United Nations to bring Iran's supreme leader before the International Criminal Court on charges of crimes against humanity.

Reza Pahlavi is among exiles working for regime change in Iran. He said at a Paris news conference that Ayatollah Ali Khamenei must be held responsible for the executions, jailing and torture of political dissidents.

Pahlavi said he will submit a complaint about Khamenei to the five permanent U.N. Security Council members along with a report of the cleric's alleged crimes that will be constantly updated.

Pahlavi's father, the late Mohammed Reza Pahlavi, was ousted in the 1979 Islamic Revolution that installed a clerical hierarchy. The ultimate leader of the government running the country now is Khamenei.

Iran has not ratified the Rome statute that established the International Criminal Court, the world's permanent war crimes tribunal, known as the ICC. It is therefore not subject to the court's jurisdiction ? unless the Security Council decides to step in and refer Iran to the court as it did in the case of Libya.

ICC prosecutor Luis Moreno Ocampo, asked about Pahlavi's announcement, said "citizens around the world are learning to request the court's intervention."

"In this sense, I think it's great to show people who are looking for justice. Now they know how to do it. We are providing a new institution to the world, to make the world better," Ocampo told a news conference in New York.

SIOUX CITY, Iowa (AP) ? Newt Gingrich says he's trying to edit himself so he doesn't come across as "zany."

Gingrich's remarks at the Republican debate Thursday night were aimed at rival Mitt Romney, who in an interview on Wednesday used the word "zany" to describe the former House speaker.

Gingrich smiled when he was asked a question about how he would counsel Republicans on the political controversy over construction of a new pipeline from Canada to the Gulf of Mexico.

Gingrich said that at times he is accused of using language that is too strong and so he was "editing" himself. He then quipped that he's very concerned about not appearing to be "zany."

Romney has stepped up attacks on Gingrich's temperament as Gingrich has vaulted to the top of the GOP field.

Police: Ohio man shot pets, cop, himself

LAGRANGE TWP., Ohio ? Police said?a man who fired at his pets and whose mother said he heard voices committed suicide after shooting a deputy Monday.

Lorain County Sheriff's Deputy Charles Crausaz, 39, was reportedly in fair condition Tuesday morning at Cleveland's MetroHealth Medical Center, according to the Plain Dealer.?Travis Stidham, 42, shot himself in a field near his home after a SWAT team, responding to a call from his concerned mother, tried to talk to him from a PA system outside the house.

"The TV was talking to him. He shot the animals and then shot the TV," Stidham's mother said he told her.

After approximately 40 minutes with no response from Stidham, he exited the home and fired at officers, Capt. James Drozdowski said. Crausaz fired twice and was struck in the armpit.

Two deputies carried Crausaz to get medical attention, the Sandusky Register reported.?Police returned fire, but it was unclear if any struck Stidham, who fled.

Police in a helicopter used infrared vision to search the area nearby, sources said, and from the sky, officers saw Stidham appear to kill himself. Elyria detectives are investigating the shooting, and an autopsy will be performed.

Having one of his officers shot was a "nightmare" for the law enforcement community, Lorain County Sheriff Phil Stammitti said.

Japan set to declare nuclear plant stable (AP)

TOKYO ? Japan's government was to declare Friday that the tsunami-devastated Fukushima Dai-ichi nuclear power plant had finally achieved a "cold shutdown," meaning it has stabilized and is no longer leaking substantial amounts of radiation.

The announcement would mark a big milestone nine months after the March 11 tsunami touched off a crisis at the plant and sent three of its reactors into meltdowns. Experts noted, however, that the facility remains vulnerable to more problems and will take decades of difficult and dangerous work to safely close down.

Prime Minister Yoshihiko Noda was to announce the government's assessment of conditions at the plant in a news conference later Friday.

The government's official endorsement of the claim by Tokyo Electric Power Co. that the reactors have reached cold shutdown status is a necessary step toward revising evacuation zones around the plant and focusing efforts from simply stabilizing the facility to actually starting the arduous process of shutting it down.

But the assessment has some important caveats.

The announcement is expected to say Fukushima has reached cold shutdown "conditions"_ a less definitive phrasing reflecting the fact that TEPCO cannot measure temperatures of melted fuel in the damaged reactors in the same way as with normally functioning ones. So the government also attached additional conditions to be met, including minimizing radiation leaks around the plant and taking backup safety measures to ensure Fukushima's wrecked reactors are safely cooled.

Even so, the announcement would mark the end of the second phase of the government's lengthy roadmap to completely decommission the plant, which is expected to take 30 years or more.
